1. Agreement and eligibility
By accessing BernStone Games or using BernStone Stacks, BernStone Flops, or their related services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
You must be at least 13 years old and old enough to agree to these Terms under the laws where you live. If you are not legally able to agree, a parent or guardian must review and accept these Terms for you.
2. The service
BernStone Games provides original browser games, local progress, public scoreboards, daily runs, friend challenges, tournaments, cosmetic progression, optional accounts, purchases, and advertising-supported features. Features may differ between games, devices, regions, and development stages.
We may add, modify, rebalance, suspend, or retire features when reasonably necessary for security, legal compliance, game quality, technical maintenance, or business operation.
3. Accounts, player names, and device saves
You are responsible for activity associated with your browser profile, friend identity, sign-in account, and any access credentials. Keep authentication and friend tokens private.
Public player names must comply with our Community Guidelines. We may reject, rename, hide, or remove names and submissions that are abusive, deceptive, infringing, unsafe, or disruptive.
Local saves can be lost when browser storage is cleared, a device fails, private browsing ends, or a profile is replaced. Use the available export feature where offered. We do not guarantee recovery of local-only progress.
4. Limited license and ownership
BernStone Games grants you a personal, limited, revocable, non-exclusive, non-transferable license to access and play the service for lawful, non-commercial entertainment. BernStone Games and its licensors retain all rights in the games, code, artwork, audio, names, marks, characters, interfaces, rules presentation, and other original content.
You may share screenshots, clips, and public score links for personal commentary and community participation. You may not sell, sublicense, copy substantial assets, reverse engineer protected systems, operate an unauthorized commercial service, or imply endorsement without permission, except where applicable law expressly permits the activity.
5. Fair play and prohibited conduct
You may not:
- Fabricate scores, alter signed or sealed results, automate competitive play, exploit bugs, or interfere with ranking integrity.
- Probe, disrupt, overload, bypass, or gain unauthorized access to the service, accounts, APIs, storage, or security controls.
- Submit unlawful, hateful, sexually explicit, threatening, deceptive, infringing, or personally identifying public content.
- Use the service to spam, impersonate, harass, scrape other players, or distribute malware.
- Manipulate advertising impressions or clicks, click your own ads repeatedly, or encourage others to interact with ads improperly.
We may invalidate results, restrict features, suspend access, or preserve evidence when reasonably necessary to protect users, rankings, providers, or the service.
6. Virtual items and points
Game points, parts, skins, backgrounds, effects, passes, badges, and other virtual items are licensed digital features. They have no cash value, are not legal tender, cannot be redeemed for money, and may not be sold or transferred unless the service expressly provides a transfer feature.
Balance changes may affect how virtual items look, unlock, or function. Paid cosmetics will not intentionally provide competitive scoring, timing, power-drop, or tournament advantages.
7. Purchases and refunds
Optional purchases are processed through Stripe or another identified checkout provider. Prices, currency, included digital items, and applicable taxes are shown before checkout. You confirm that you are authorized to use the selected payment method.
BernStone Games currently offers one-time digital purchases rather than recurring subscriptions unless checkout clearly states otherwise. Refunded, reversed, fraudulent, or charged-back purchases may have their associated digital entitlements removed.
Refund requests are handled under our Refund Policy and applicable consumer law. Nothing in these Terms limits rights that cannot legally be waived.
8. Advertising and rewarded features
The service may display advertising supplied by Google or other identified providers. Passive advertising is separated from live controls and game outcomes. An optional rewarded ad may provide the specifically disclosed in-game reward only after the advertising provider confirms completion.
You are never required to click an advertisement. Ad availability, content, and rewarded inventory may vary. See our Advertising Standards and Cookie Policy.
9. Third-party services and links
Authentication, payments, hosting, advertising, social sharing, and other features may rely on third-party services. Their separate terms and privacy policies apply to their services. BernStone Games is not responsible for third-party content or services beyond the responsibilities imposed by law.
10. Availability, disclaimers, and liability
The service is provided on an “as available” basis. To the maximum extent permitted by law, we do not promise uninterrupted access, perfect compatibility, permanent rankings, error-free code, or that every feature will remain available.
To the maximum extent permitted by law, BernStone Games is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, or loss of local progress arising from use of the service. Where liability cannot be excluded, it is limited to the greater of the amount you paid BernStone Games during the previous twelve months or CAD $100, unless applicable law requires a different remedy.
11. Governing law and disputes
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law rules. Mandatory consumer protections and rights in your place of residence continue to apply.
Before filing a claim, please contact us and provide a reasonable opportunity to resolve the issue informally. Nothing here prevents either party from seeking urgent relief or using a consumer-protection process that cannot be waived.
12. Changes, termination, and contact
We may update these Terms. Continued use after an updated version becomes effective means you accept the revised Terms to the extent permitted by law. If a change materially affects paid rights, we will provide any notice or remedy required by law.
You may stop using the service at any time. We may suspend or terminate access for material or repeated violations, fraud, security risk, legal requirements, or discontinuation of the service.
